Joy’s Fitness Hub (JFH) operates the joysfitnesshub.com website (including all content and functionality available through the joysfitnesshub.com domain name and any country or region specific domains or sub domains (jointly referred to as the “Site”).

JFH is committed to ensuring the privacy and protection of information users enter into the Site. The following privacy policy governs JFH’s practices for information collection, use and retention on the Site. It should be read with:

(2) Any other policy developed by JFH from time to time and notified on the Site or any part of the Site (including the Joy’s Fitness Hub Terms of Use if you are a subscriber).

—"you" means you, the person using our services, or visiting the Site

—"Group Companies" means Off The Track Training Pty Ltd and all subsidiaries and affiliate companies from time to time owned by Off The Track Training Pty Ltd (other than us) providing fitness-related goods and services.

Consent to collection and use of information

By:

  • submitting your information when you register for the Joy’s Fitness Hub subscription service (the “Services”);
  • signing up to receive our newsletter or other information or offers from us through the Site; or
  • browsing the Site or app,

you agree that we may collect, retain and use information about you in accordance with this Privacy Policy.

The Services may be provided to you on our desktop site, or via our app.

Types of Information Collected

When you sign up to receive the Services we will ask you for certain contact information such as your name and your address (which must be provided so that we can provide the Services to you) as well as other information about you such as your gender, date of birth and how often you work-out (you do not have to provide this information if you choose not to).

You may also provide us with your information to subscribe to keep up to date with the latest information and offers from Off The Track Training & JFH.

Where lawful to do so, we may also collect information about you from public sources and third parties, including service providers, individuals whom you have confirmed may provide personal information about you to us and government, tax or law enforcement agencies. We may also collect personal information about you from your use of other services provided by any of our Group Companies, or your purchase of products from them.

As you navigate within the Site or app, we will also automatically track, collect and store information about you, your use of the Site or app, your computer, or other device that you use to access the Site and receive the Services. This information may include some or all of the following information about you and your visit:

—the IP address of your computer or device when connected to the Internet and the domain name from which you are accessing the Internet;

—the operating system and the browser your computer or device uses, and any search engine you are using;

—the date and time you are visiting;

—the URLs of the pages you visit.

We also use third party services such as Google Analytics to collect information about visitors to the Site. This information is aggregated to determine number of visits, average time spent, pages viewed, etc. We use this information to measure the usage of the Site, and to improve the content as well as the value of the Site. If you download the app to receive the Services, we will also (where you agree that we may do so) collect geo-location data in relation to the device that you are using.

While your browser may also allow you to send a “do not track” signal when you visit our Site, we do not modify our practices in response to the signal. We will continue to comply with this Privacy Policy in any event.

Purpose for which Information is Collected and Use of Information

We may use the information we collect to:

  • Provide the requested Services to you and to administer any payments for those Services;
  • Send you our newsletter or other information where you have requested that we send it to you;

  • Share your information with our Group Companies. These Group Companies, when handling this information, will follow practices that are consistent with the practices described in this Privacy Policy.

JFH and its Group Companies will not provide or release your personal information to a third party unless you have opted-in to receive marketing communications from them. We and our Group Companies will provide you with a facility enabling you to unsubscribe or “opt-out” of receiving any further marketing communications each time we or they send such a communication to you.

Although we may publish aggregated information about usage patterns which does not identify individuals, we do not disclose information about individuals except as set out in this privacy policy. We do not sell information that identifies you personally.

The Site may contain links to other websites. We are not responsible for the reliability of the content or privacy practices of such other websites.

While we take reasonable efforts to safeguard your personal information, we cannot guarantee the security of any personal information you disclose online. You accept the inherent security implications of dealing online and will not hold us responsible for any breach of security unless such breach has been caused by our specific negligence.

Children

We do not knowingly collect information from children under the age of 13 and the Site and app are not targeted to children under the age of 13. We encourage parents and guardians to take an active role in their children’s online activities and interests.

Lost or Stolen Information

You must not share your user same or password with anybody and you should keep these secure. Please notify us promptly if your user name or password is lost, stolen or used without permission. Upon notice, we will cancel that user name or password and update our records accordingly. We recommend that different passwords are used for all of your online accounts.

Opt-Out Option

You have the right to decline use of personal information for marketing communications. The records for those individuals who request that their personal information not be used for future marketing mailings will be marked in our records so that their names will be excluded from any contact of that type in the future unless they later request or agree to future contact.
